Barnrise is an Android app published by Yellow8 Studios LLC, a Texas limited liability company ("Yellow8 Studios," "we," "us," "our").
By downloading or using Barnrise, you agree to these Terms of Service and to the Barnrise Privacy Policy. If you do not agree, please do not use Barnrise.
Barnrise is a general-audience alarm clock and does not require an account. If you are under the age of majority where you live, you may use Barnrise only with the involvement of a parent or guardian, and only a person able to enter into a binding contract may buy Barnrise Plus. Purchases are subject to Google Play's own age and payment requirements.
Barnrise is an alarm clock with a farm you look after. It wakes you with a sound, asks you to complete a short wake-up task, and lets you feed and collect animals as you keep a streak going.
PLEASE READ THIS SECTION CAREFULLY.
Barnrise depends on your phone. An alarm may fail to sound or fail to sound on time for reasons outside our control, including: the phone being switched off, out of battery, in silent, Do Not Disturb, or a focus mode; the volume being turned down; a battery-saver, "deep sleep," or app-hibernation feature closing Barnrise in the background (several Android manufacturers do this aggressively by default); permissions for notifications, exact alarms, or full-screen alerts being denied or revoked; a system update, restart, or crash; headphones or a Bluetooth device capturing the audio; or a bug.
DO NOT RELY ON BARNRISE ALONE FOR ANY WAKE-UP WHERE FAILING TO WAKE COULD CAUSE HARM, LOSS, OR INJURY — including medication schedules, medical or care obligations, work involving safety, travel, or any other time-critical duty. Use a second, independent alarm for those. You are responsible for testing that Barnrise works on your particular phone, and for granting the permissions it needs.
Barnrise is not a medical device. Nothing in it diagnoses, treats, or monitors any condition, and nothing in it is medical, health, or sleep advice.
Anything you type into Barnrise — the names you give your animals, your reminders — is yours. It is stored on your phone and never sent to us, so we neither hold it nor claim any rights in it. See the Privacy Policy for detail.
6.1 What the plans are. Barnrise offers two auto-renewing subscription plans — Monthly and Annual — and one one-time purchase, "Lifetime access." All three are sold, billed, and canceled through Google Play. Google is the merchant of record; we are not. Prices are shown in your local currency by Google Play before you confirm, and the price Google shows you is the price that governs.
6.2 What Plus includes. Barnrise Plus unlocks every wake-up task, every alarm tone including the animal voices, every sleep sound, the affirmation morning messages, per-day alarm times, the reminders list, and the ability to adopt every animal in the barn. Barnrise without Plus is still a complete alarm clock: the alarm itself, the alarm time, the tone volume, auto-silence, the math wake-up task, a sleep sound, and a morning verse all work without paying. Adopted animals are still earned with gold; Plus opens the barn, it does not empty it.
6.3 Subscriptions renew automatically. Monthly and Annual subscriptions renew automatically at the then-current price until you cancel. You will be charged through your Google account at the start of each billing period.
6.4 How to cancel. You may cancel at any time in the Google Play Store: Play Store → your profile icon → Payments and subscriptions → Subscriptions → Barnrise → Cancel subscription. Cancellation takes effect at the end of the billing period you have already paid for, and you keep Plus until then. Uninstalling Barnrise does not cancel a subscription.
6.5 The 7-day free trial on the Annual plan. Where Google Play offers you a free trial, the trial length, the price that follows it, and the date of the first charge are shown by Google before you confirm. For the Annual plan the trial is 7 days.
6.6 What "Lifetime access" means. Lifetime access is a single payment that entitles you to Barnrise Plus for as long as Barnrise is offered as a service. It is not a subscription, nothing renews, and there is nothing to cancel.
The "lifetime" is the product's, not yours. It is not a promise that Barnrise will be offered indefinitely, and it does not entitle you to any future separate app we may publish. It does entitle you to Barnrise Plus on any Android device signed in to the Google account you bought it with, for as long as Barnrise remains available — including through the updates we release in that time.
6.7 If we ever discontinue Barnrise. We may stop offering Barnrise. If we do, we will give holders of Lifetime access at least 90 days' notice before Barnrise stops working, published in the Barnrise Google Play listing, shown inside the app, and posted on our website. We cannot email you, because Barnrise deliberately holds no email address and no account for anyone.
Nothing needs to be exported. Everything Barnrise saves — your alarms, your farm, your reminders — is already stored only on your own phone, and a discontinuation does not reach in and take it. A version of Barnrise you have already installed continues to work on your device until you remove it or until your phone's operating system stops supporting it, which is not something we control.
Nothing in this section limits any refund right you may have under Google Play's policies or under applicable law.
6.8 Changes to plans and prices. We may change prices, and we may change what a plan includes, for future purchases. A change will not remove a feature from Lifetime access that was included in it at the time you bought it, except where we are required to remove it by law, by Google Play policy, or because a third party we depend on withdraws it. Price changes to an existing subscription are subject to Google Play's rules, which require notice to you and, in most cases, your consent before a higher price is charged.
6.9 Withdrawing a plan from sale. We may stop selling any plan, including Lifetime access, at any time. Withdrawing a plan from sale does not affect anyone who has already bought it.
6.10 Restoring a purchase, and what happens if Plus lapses. Barnrise asks Google Play what your Google account owns every time it starts, and the paywall has a Restore purchases button. Reinstalling the app, or installing it on a new phone with the same Google account, restores Plus.
If a subscription lapses, Barnrise returns to the free settings: a Plus alarm tone, task, sleep sound, or morning message reverts to a free one so that your alarm keeps working. Animals you have adopted and reminders you have written are kept, not deleted — those are yours, not the subscription's.
6.11 Refunds. Refunds are handled by Google under Google Play's refund policy. We cannot issue a refund for a Google Play purchase ourselves. If you have a problem we may be able to fix, please write to us first at [email protected].
6.12 Transfer. If Barnrise, or the business that operates it, is sold or transferred, the obligations in this Section 6 transfer with it and bind the acquirer.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Barnrise on devices you control, for your own non-commercial use, in accordance with these Terms and with Google Play's terms.
You agree not to: copy, modify, reverse engineer, decompile, or create derivative works from Barnrise except to the extent that restriction is unenforceable under applicable law; work around or tamper with the paywall, the entitlement checks, or Google Play Billing; redistribute, resell, rent, or sublicense the app; or use it in any unlawful way.
Barnrise, including its name, artwork, animal characters, animations, audio, and text, is owned by Yellow8 Studios LLC and protected by copyright and other laws. Buying Barnrise Plus buys access to features; it does not transfer ownership of anything.
BARNRISE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, YELLOW8 STUDIOS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT BARNRISE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ALARM WILL SOUND AT ANY PARTICULAR TIME OR AT ALL. See Section 4.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, YELLOW8 STUDIOS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, WAGES, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO BARNRISE — INCLUDING ANY LOSS ARISING FROM AN ALARM THAT DID NOT SOUND, SOUNDED LATE, OR WAS NOT HEARD — WHETHER BASED ON CONTRACT, WARRANTY, TORT, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO BARNRISE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID US OR THROUGH GOOGLE PLAY FOR BARNRISE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) TWENTY-FIVE U.S. DOLLARS ($25.00).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or for anything else a governing law does not permit us to disclaim. Nothing in these Terms waives, limits, or disclaims any right or remedy you may have under the Texas Deceptive Trade Practices–Consumer Protection Act, and no such waiver is sought or intended. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
You may stop using Barnrise at any time by uninstalling it. Uninstalling does not cancel a subscription — see Section 6.4. We may suspend or discontinue Barnrise or any of its features as described in Sections 6.7 through 6.9.
We may update these Terms. When we do, we will change the "Last updated" date at the top and post the updated version at the same address. If a change is material, we will make it visible in the app before it takes effect. Continuing to use Barnrise after a change takes effect means you accept the updated Terms. A change to these Terms will not retroactively reduce what Lifetime access included when you bought it — see Section 6.8.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Texas will have jurisdiction — except where the law of your country of residence gives you the right to bring a claim, or requires a claim against you to be brought, somewhere else. Nothing here deprives a consumer of the protection of mandatory law in their home jurisdiction.
If any provision of these Terms is held unenforceable, the rest remains in effect and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Yellow8 Studios LLC regarding Barnrise. You may not assign these Terms; we may assign them as described in Section 6.12.
